PROSECUTION
PROTOCOL:
Working with Law Enforcement:
1. Issue search warrants as needed according to interpretation
of the investigative findings and other legal necessities.
2. Discuss with investigating officer any further evidence
that may be needed to move forward with prosecution.
3. Review evidence provided by the investigating detective and
hospital exam then make a determination on whether to proceed
with prosecution.
Working-with Rape Advocate and Victim Witness Advocate:
1. Maintain interagency communication with the Victim Witness
Advocate that is involved in working with the victim so they
can prepare the victim emotionally then
make appropriate follow-up contact with the victim and keep
communication lines open.
2. Advise Victim Witness Advocate of case status and progress
so they can make appropriate follow-up contact with victim and
AARC Rape Advocate.
VICTIM WITNESS ADVOCATE PROTOCOL:
1. The Victim Witness Advocate will maintain interagency
communication with the prosecutor’s office and the AARC Rape
Advocate.
2. The Victim Witness Advocate will make appropriate follow-up
contact with victim and AARC Rape Advocate. Victim Witness
Advocate will keep communication lines open until court
hearing and sentencing is completed
3. The Victim Witness Advocate will be available to victim
during any meetings with the prosecuting attorney.
4. The Victim Witness Advocate will assist victim with
employer intervention.
5. The Victim Witness Advocate will provide notice and/or
accompany rape victim to any court proceedings to provide
support and explain the criminal justice process.
6. The Rape Advocate will
provide emotional support and follow-up services per/request
by V/W Advocate or victim during and after court proceedings.
7. Victim Witness Advocate will
assist with recovery of evidence following court proceedings
(clothing etc.).
8. Victim Witness Advocate will handout and review "Victim
Service Brochure" for post-sentencing guidelines/issues. |
