BACKGROUND |
| In 1987, a
multidisciplinary task force of representatives from law
enforcement, the medical community, rape crisis
organizations, the North Dakota Hospital Association, the
Attorney General’s office, the Department of Human
Services, and the Department of Health and Consolidated
Laboratories was formed to develop materials to encourage
uniform procedures to reduce the trauma of victims of
sexual assault and enhance the quality and quantity of
evidence to facilitate prosecution of the crime. Input
from the task force members and public hearings throughout
the state reinforced the decision to develop the Sexual
Assault Evidence Collection Protocol and the Sexual
Assault Evidence Collection Kit. The task force adopted
the U.S. Department of Justice’s Protocol as the framework
for the North Dakota Sexual Assault Evidence Collection
Protocol, modifying it to accommodate the needs of
professionals and facilities within North Dakota. |
| In 1994,
under the direction of then Attorney General Heidi
Heitkamp, the Protocol was revised and edited to
coordinate medical and law enforcement response to the
needs of sexual assault victims with the goal of
facilitating the successful prosecution of the offender. |
| In 2001, a
multidisciplinary ad hoc committee or “Team” was formed
and funded by the North Dakota Council for Abused Women’s
Services. Members of the 2001 team represented the
medical, legal, law enforcement, victim advocacy and
forensic science professions. The team was experienced in
working with sexual assault victims. Recommendations were
based upon the physical and emotional needs of the sexual
assault victim, reasonably balanced with the basic
requirements of the legal system. While North Dakota
shares wide diversity in training, education, facilities,
and cultures, it is the hope of the 2001 Team that this
Protocol and Sexual Assault Evidence Kit will allow each
community to prepare a response through a local team
prepared to take action when a sexual assault victim comes
forth. |
